Preamble

The terms and conditions of sale described below detail the rights and obligations of Editions HOPE and its customers in the context of the sale of goods and services.

These general conditions of sale apply to all orders placed with Editions HOPE for all the items and services offered on the site https://www.editions-hope.com by non-commercial individuals. Consequently, the fact for any person ordering a product or service offered on sale on the website of Editions HOPE implies full and complete acceptance of these General Conditions of Sale that the Customer recognises having been aware of and having read before his order.

Editions HOPE reserve the right to modify at any moment the present General Conditions of Sales. Nevertheless, the General Conditions of Sale applicable to the order placed by a Customer on the website of Editions HOPE are those accepted by the Customer at the time of placing the order.

Editions HOPE deals with the occasional or permanent sale of all products or services that fall within the scope of its goals or that may contribute to their achievement. Integrality

The present General Conditions of Sale define the entirety of the obligations of the various parties. In this sense, the Customer is considered to accept without reserve the entirety of the provisions envisaged under these general sales conditions. Editions HOPE is for its part committed to respecting its role of retailer within the framework of the aforesaid conditions.

Purpose

The present General Conditions of Sale have the aim of defining the rights and obligations of the various parties within the framework of the online sale of goods and services proposed by the Editions HOPE to the Customer, from the order to the delivery, including payment and the use of services made available by Editions HOPE.

Field of application

These General Conditions govern the sale of products and services on the day the Customer places an order. They apply to all methods of placing orders offered by Editions HOPE, whether the order is placed directly, by internet, by mail or by telephone.

Capacity to enter into contract

Any Customer of Editions HOPE declares to have the capacity to enter into a contract on the conditions described hereafter, i.e. to be an emancipated minor or have reached legal majority and not to be protected within the meaning of article 488 of the French Code Civil. Editions HOPE reserve the right to refuse any order by a Customer with whom there exists, or which appears during processing, a dispute, in particular a dispute over payment.

Acceptance of General Conditions of Sale

The act of the Customer to tick/check the box "I have read and I accept the general conditions", before proceeding to secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases envisaged under the present general sales conditions under the paragraph 6 "Return". The Customer acknowledges by this act to having read and understood the present Conditions and to accept them.

The purchase by phone or mail also implies the acceptance of these Conditions which the Customer recognises to have read beforehand, and to have understood and accepted the conditions mentioned above.

1. Order

1-1. To place an order

On our website https://www.editions-hope.com/shop, it is possible to place an order 24 hours a day, 7 days a week.

You make your selection by browsing the pages of our website. Your selections are added to your cart when you click Add to cart. At any time during your navigation to our website, you can place your order by clicking on Checkout.

1-2. Validation of the contract

When you click on Check Out, you'll have a message of confirmation. It summarizes all of the products and options selected. You must verify in this form all of the informations transmited and all of the elements necessary for the dispactch of your order (delivery address, digital code, phone number...).

If you don't need to modify the form, you must then read the General Conditions of Sale and tick the box "I have read and agree to the website terms and conditions". To continue and place your order, you must click on Place Order or Proceed To Paypal according the payment method selected. After payment on the secure server (see 4. Payment methods), a confirmation of the order is displayed. It confirms the registration of your order and informs you that an email of confirmation will be sent to you as soon as possible.

Any order implies acceptance of the prices and descriptions of the products available for sale. Any dispute on this point will occur within the framework of a possible exchange and guarantees mentioned below.

In every case, the online supply of the bank card number or the selection of the payment method and the final validation of the order by the Customer will constitute proof of the order and current liability for the sums for the products selected in the order. This validation constitutes signature and acceptance of all the operations carried out on the site.

1-3. The technical means for identifying and correcting errors

You have at any time the ability to identify and correct any errors you have made when entering your data. When you find an error after the conclusion of the contract, you must contact us by email at shop@editions-hope.com within 24 hours after validation of your order.

Editions HOPE cannot be held responsible for any data entry errors and the consequences in terms of delay or delivery error. In this context, all expenses engaged for resending will be the charge and responsibility of the Customer.

1-4. Tracking of an order

You can check the status of your order at anytime by consulting the section My account.

This tracking allows the Customer to know the processing status of his order, but also the shipping or delivery status of his packages. This delivery's following is carried with the deliverer's Internet interface. Editions HOPE cannot therefore be held responsible for unavailability or errors that may affect the information provided by its carriers. Editions HOPE endeavors to make this information as clear as possible and to make transport with its carriers as reliable as possible.

You can at any moment contact us in order to be informed of the stage of your order.

1-5. Terms of archiving and access to the contract

Editions HOPE undertake a dematerialized archiving of contracts, orders and invoices. You have a right of communication to these documents on request, by contacting us. You can also find the history of your orders and invoices in the My Account section.

1-6. Personal data

Your personal data will be used to process your order, support your experience throughout this website, and for other purposes described in our privacy policy.

2. Informations about the products

2-1. Characteristics of the products and services

The information, characteristics, photographs and graphics presented on the website or in the e-mails sent by Editions HOPE are given for a purely indicative basis. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the products cannot engage the responsibility of Editions HOPE. We do our utmost to ensure that the photographic representation of the products is as accurate as possible. It is nevertheless possible that the perception of the product does not correspond completely to the products. The products are sometimes presented in photography with other products. The description will mention what does or does not form part of the product. Most of the photographs presented on the site are computer images (called mock-ups). They are used to give the most accurate representation possible of the product.

The essential characteristics of the services are described on the pages published on the website and are recalled in the summary of the order.

2-2. Availability of the products

Editions HOPE are committed to delivering the orders received only within the limit of the stocks of the product available or within the limit of the stocks available from its suppliers. In the absence of availability of the product, Editions HOPE are committed to informing the Customer as quickly as possible. Editions HOPE reserves the right to modify the selection of products according in particular on the constraints imposed by its suppliers.

The unavailability of a product is mentioned on the product page concerned or in the shopping cart summary. Thereby, products may appear with the mention of delivery times, such as "in stock", "4 to 8 days", "1 to 2 weeks", "4 to 6 weeks", "Product not available"...

Delivery times indicated in the product page details are estimated times when the products are not available in stock. They may be susceptible to variations for which the Customer will be informed of this in their order tracking in the event of a minor delay or by email in the event of a more prolonged delay.

If Editions HOPE cannot obtain an ordered product from its suppliers, we will notify the customer of the expected delay by email. The customer in turn can either ask a refund of the sums paid within 30 days, or the exchange of the unavailable product for another product, or the cancellation of the order. No cancellation penalty will be applied for such an order cancellation. No cancellation compensation (other than the full refund of the order) can be asked, such an unavailability having resulted from a delay in updating this unavailability.

Most of the products available on the website are supplied by several providers. Additional delivery time may be required in some cases. You will be notified by email.

Editions HOPE cannot be held accountable for the non-fulfillment of an agreed contract in the case of the product being out of stock or unavailable, of causes beyond control, of disruptions caused by partial or all-out strikes, in particular of the postal services, transport, and communications, flooding and fires...

3. Prices

Product prices are indicated in €uros, all taxes included.

Price offers are valid only in the double limit of the validity period of the offer and the availability of the products.

Our offers of goods and prices are valid if they are online on our website on the day of the order.

If the Customer requests delivery outside French territory, the order may be subject to taxes and customs duties when it arrives at its destination. Payment of these fee is the responsibility of the Customer.
We invite you to check with the relevant authorities in your country. You should also check the possibilities of importation or use of the products you order from us in the country of destination.

4. Payment Methods

The shop of Editions HOPE accepts different payment methods.

Payment by check is not anymore available for online purchases.

4-1. Cards

Visa, MasterCard, American Express, other cards.

The transaction is carried out via Paypal which alone receives the banking information provided on the site at the time of the payment. When you enter your card number to pay for your purchases, in reality you transmit your banking data directly to Paypal, which records them in its highly-protected server. This information is not forwarded by any intermediary, not even Editions HOPE, and is not stored either by our technical service providers.

You can use your credit card or pay directly with your Paypal's Account. Using Paypal is completely free.

4-2. Wire transfer

You have a period of 7 days to make the bank transfer to us. The order is dispatched once the payment has been received.

The bank details are communicated to you once the payment method has been validated. They are also sent to you by email.

4-3. Invoice

The purchase order that the Customer creates online or the order confirmation sent by email to the Customer by Editions HOPE does not act as an invoice. The Customer has the original invoice in his online account. The invoice does not come with the parcel.

Editions HOPE keep an electronic copy of each invoice.

In the case of delivery to a different address from the billing address, the invoice is only available in the Customer's online account.

4-4. Transfer of property

Editions HOPE remains owner of the Products delivered until their complete payment by the Customer.

5. Delivery

5-1. Delivery service

Products are delivered to the address indicated by the Customer on the purchase order, according the type of shipping selected.

5-2. Delivery schedule

Products available to purchase are on the website are in stock and orders are processed daily from Monday to Friday, except for national holidays.
All orders are dispatched after receiving the complete payment.
You will be notified by email to let you know when your order being shipped.

Transport times depend on the transporter chosen by the Customer and the place of delivery.
Generally, for metropolitan France, the delivery is between 2-7 business days from the shipping date.
For Europe, it is around a week.
For the rest of the world, it is more than a week.

In case of delay in delivery, we will notify you by email as soon as possible and we will inform you of the new delivery date.

5-3. Delivery methods

For Metropolitan France, you can choose between 2 shipping methods:
- Sending by Regular Mail
- Sending by Colissimo Suivi (package with tracking number)

For the rest of the world, you can choose between 2 shipping methods:
- Shipping by Colissimo International (package with tracking number)
- Shipping by UPS

You choose the shipping method in the order validation process.

5-4. Delivery cost

The rate charged for the shipping of your order is based on the weight of your products, and your location.
They are given when you valid your order, before the payment page.

5-5. Packaging

The products are packaged to comply with the standards of transport, and to ensure an optimal protection of the products during their delivery. It is requested from the Customer to respect these same standards in the case of a product being returned because of after-sales service or for reasons of suitability. Any damage noted to a product arising from the product not being repackaged properly may lead to an only partial refund, or no refund in the event of the impossibility of resale in its state or in the event of a technical problem indicated having been worsened.

5-6. Verification of the parcel upon arrival

Editions HOPE remind that it is the responsibility of the Customer to inspect their parcels upon reception in the presence of the delivery person and to immediately notify the carrier of any anomaly (bumps, damaged package, delivery date not in accordance with normal delivery service deadlines...).

The Customer must also inform Editions HOPE by email as quick as possible, so that the necessary measures can be taken.

6. Return

Within the framework of distance selling (without the simultaneous physical presence of the parties), according to Article L 121-20 of the French Consumer Code, the Customer has the right, to a 14 days period, to exert his right of withdrawal without having to pay penalties, except the costs of returning the goods. This period begins from the day of reception of the goods by the Customer.

The request to return the goods can be carried out by contacting Editions HOPE by using the contact form or by email at shop@editions-hope.com. The Customer will be informed of the steps to follow.

Editions HOPE highly recommend the Customer to return its products by registered mail or with additional insurance, guaranteeing him, if necessary, the compensation of products matching their real commercial value in the event of spoliation or loss of these goods. In all cases, the return is carried out at the Customer's own risk. It will be up to the customer to keep all proof of return. The return fees are at the charge of the Customer, who is free to choose the shipping method. No package sent in "cash on delivery" mode will be accepted by Editions HOPE.

In return of the respect of this procedure, Editions HOPE undertake to exchange or refund the product within a maximum period of 30 days upon reception of the returned goods.

This right of withdrawal is exerted without penalty, except for the transport costs which remain at the charge of the Customer.

In the event of a mistake from Editions HOPE side (defective item or order preparation error), our services will bear the costs of returning the item. The customer must send the carrier's invoice by email to shop@editions-hope.com to get compensation.

Returned products must be intact, in perfect state for resale, in their original packing. They cannot be used or to have suffered even minimum deterioration. Any product which is damaged, incomplete, or whose original packing is deteriorated, will be neither refunded nor exchanged.

7. Responsability

In accordance with article 4 of decree n° 78-464 of 24th march 1978 of French law, the present provisions cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of the hidden defects of the item being sold.

The Customer is expressly informed that Editions HOPE is not the manufacturer of the products presented within the framework of our website, within the meaning of law n ° 98-389 of May 19, 1998 and relating to liability for defective products.

The products on the shop comply with current French legislation and norms applicable in France. Editions HOPE cannot be held responsible in the event of the non-respect of legislation in the country where products are delivered. It is the responsibility of the Customer to check with local authorities the legality of importing and using the products and services.

We do our best to satisfy you. We are responsible for the proper execution of General Conditions of Sale. However, Editions HOPE cannot be held responsible in the case of circumstances beyond their control, in case of force majeure, the unpredictable and insurmountable fact of a third party to the contract or the fact of the product's non-compliance with foreign legislation in the event of delivery in a country other than France.

8. Duration and application

The present Conditions apply throughout the time of all online services offered by Editions HOPE. They can be modified at any time. The applicable Conditions are those in force on the date of registration of the order.

Sales of Editions HOPE products are subject to French law. Any dispute relating to the existence, interpretation, execution or breach of the contract concluded between Editions HOPE and the Customer, even in the event of a plurality of defendants, in the absence of a mutual agreement, will fall under the exclusive jurisdiction and competence of courts of Paris.
